The Islamabad High Court Bar Association (IHCBA) remains undecided on its stance as the Supreme Court of Pakistan begins hearings today on petitions challenging the transfer of three judges from other high courts to the Islamabad High Court (IHC).

These petitions, including one filed by the IHCBA, question the constitutionality of the transfers and their impact on the seniority of existing IHC judges. The IHCBA’s petition specifically contends that the transfer power has been used to punish and sideline already serving judges at the IHC, while favoring newly transferred judges .
A constitutional bench of the Supreme Court, led by Justice Muhammad Ali Mazhar, is set to hear these cases. The petitioners argue that the transfers violate constitutional provisions, including Articles 175(A) and 194, and lack a basis in public interest .
The outcome of these hearings could have significant implications for judicial appointments and the balance of power within Pakistan’s judiciary.
