SC lacks jurisdiction in NAB cases: gov

Islamabad, July 13: The federal government has argued that the Supreme Court does not have jurisdiction in matters governed by the National Accountability Bureau (NAB) under the applicable legal framework, presenting its position during proceedings involving accountability laws.

In its submissions before the court, the government maintained that NAB-related cases are subject to a specific legal process established under the National Accountability Ordinance (NAO), with designated accountability courts and appellate forums responsible for hearing such matters. Government lawyers contended that these statutory mechanisms should be followed before any constitutional questions are raised.

The argument came during hearings concerning the interpretation of accountability laws and the extent of judicial oversight. Counsel for the government emphasized that respecting the legal framework enacted by Parliament is essential for maintaining the separation of powers and ensuring consistency in the administration of justice.

Lawyers representing opposing parties challenged the government’s stance, arguing that the Supreme Court retains constitutional authority to examine matters involving fundamental rights, questions of public importance, and the interpretation of the Constitution, regardless of the statutory forum involved.

Legal experts say the case could have significant implications for Pakistan’s accountability system, as the court’s eventual ruling may clarify the limits of judicial review in NAB proceedings and define the relationship between constitutional jurisdiction and specialized accountability laws.

The Supreme Court is expected to continue hearing arguments from all parties before issuing a detailed judgment. Observers believe the decision could shape future accountability litigation and provide important guidance on the constitutional powers of the country’s highest court.
